Following a lawsuit from a conservative legal group seeking documents related to the DA’s 2020 election interference case, a judge in Georgia ordered Fulton County District Attorney Fani Willis to produce any records from special counsel Jack Smith or the U.S. House select committee that looked into the Capitol attack on January 6.
The order comes after Judicial Watch, a conservative nonprofit organization, sued Willis in March after Fulton County alleged it lacked responsive records from the House select committee and the special counsel’s office.
Judge Robert McBurney of the Fulton County Superior Court ruled on Monday that Willis had violated the state’s open records act by neglecting to reply to the lawsuit and ordered her to produce any records within five business days.

In December 2021, Willis wrote to then-committee Chairman Bennie Thompson, requesting “access to records that may be relevant to our investigation.” Trump’s legal team had already attempted to obtain any correspondence between Willis and the House Select Committee.
Attorneys for the Fulton County district attorney’s office attested during a court hearing in January that they had either provided any pertinent committee records or that the records were already available to the public.
Nathan Wade, a former prosecutor, claims that although prosecutors met with the committee on January 6, “no tangible documents were shared.”
Following an attempt by Trump and his co-defendants to have Willis removed from the case due to her relationship with Wade, Trump’s criminal case in Georgia has been put on hold.
Willis was not disqualified by Fulton County Judge Scott McAfee, but the case has been put on hold while Trump and his co-defendants appeal the ruling.
Originally set for December 5, the appeal’s oral argument was abruptly and mysteriously canceled last month.
